Introduction

Welcome to deckai.co, operated by DeckAI Inc. ("we," "our," or "us"). These Terms of Service ("Terms") govern your use of the alpha or beta version of the DeckAI PowerPoint add-in ("the Application") and any associated services provided during this pre-release phase (collectively, "the Service"). By accessing or using our Service, you agree to comply with and be bound by these Terms. If you do not agree, you must not access or use the Service. 

Important Note: This is a pre-release version of the Application, and its functionality, performance, and availability may change. The Service is provided "as is" without any guarantees of stability or accuracy. 

Eligibility and User Accounts 

  • To participate in the alpha/beta program, you must register and create an account by providing your name and email address.
  • You are responsible for maintaining the confidentiality of your account credentials and all activities that occur under your account.
  • Participation is limited to users who have been invited or approved by us. We reserve the right to revoke access at any time. 

Pre-Release Nature of the Service

  • The Service is provided for testing and feedback purposes only and may contain errors, bugs, or other issues. 
  • Features and functionality are subject to change without notice.
  • We may request your feedback on the Application. By providing feedback, you grant us a non-exclusive, royalty-free, worldwide license to use, modify, and incorporate your feedback into the Service without any obligation to you. 

Prohibited Uses

When using our Service, you agree not to: 

  • Reverse engineer, decompile, or disassemble the Application or its features. 
  • Share access to the Application or any pre-release information without our consent. 
  • Use the Application for any unlawful, harmful, or abusive purposes. 

We reserve the right to terminate accounts or suspend access for violations of these Terms. 

Intellectual Property Rights

All content, trademarks, and intellectual property associated with the Service remain the exclusive property of DeckAI Inc. You are granted a non-exclusive, non-transferable, limited license to use the Application solely for testing purposes in accordance with these Terms.

Privacy and Data Use

  • Your use of the Service is governed by our Privacy Policy, which can be found on our website at www.deckai.co/privacy-policy. 
  • Any data collected during the alpha/beta phase, including feedback, usage analytics, and error logs, will be used to improve the Service.
  • DeckAI complies with applicable data protection laws, including GDPR and CCPA, where relevant.

Disclaimer of Warranties

The Service is provided "as is" and "as available" without any warranties, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement. 

We do not guarantee uninterrupted or error-free service or that the Service will meet your expectations.

Limitation of Liability

To the maximum extent permitted by law, DeckAI Inc. is not liable for any direct, indirect, incidental, consequential, or special damages arising from your use of the Application, including but not limited to data loss or service interruptions. Use of the Service is at your own risk.

Changes to Terms

We reserve the right to update these Terms at any time during the alpha/beta phase. Users will be notified of significant changes via email or a prominent notice on our website. Continued use of the Service after updates constitutes acceptance of the revised Terms. 

Termination

  • We may suspend or terminate your access to the Service at any time for any reason, including violations of these Terms or completion of the alpha/beta phase. 
  • Upon termination, all rights to use the Application immediately cease. Data collected locally on your device will remain but may not be usable without the Application. 

Dispute Resolution

  • Arbitration: Any disputes arising under these Terms will be resolved through binding arbitration in accordance with the rules of the American Arbitration Association. 
  • Mediation: Before arbitration, parties agree to attempt resolution through mediation. 
  • Disputes will be resolved exclusively in the courts of Delaware, USA, if arbitration is not feasible. 

Governing Law

These Terms are governed by the laws of the State of Delaware, USA. Any disputes will be resolved under these laws.
